Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to BrainDrive services operated by BrainDrive LLC (“BrainDrive,” “we,” “us,” or “our”), including BrainDrive Concierge (managed hosting), BrainDrive Models (pay-as-you-go AI credits), and the BrainDrive Community (community.braindrive.ai). By using any BrainDrive service, you agree to follow this policy.

This policy does not apply to self-hosted BrainDrive installations. If you run BrainDrive on your own hardware without using any BrainDrive service, what you do with your installation is your business. This policy only governs your use of services operated by BrainDrive LLC.

This AUP is part of our Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.

Our Approach

BrainDrive is built on the belief that you own your data. Your Library is your personal knowledge system — we treat it the way a storage provider treats a locked filing cabinet.

We do not routinely or proactively monitor, review, or access the content you store in your Library or your chat history. We believe your Second Brain should be as private as your first one.

However, operating a shared platform requires boundaries. This policy defines those boundaries — what you can and cannot do on BrainDrive’s managed hosting service.

What You Can Do

BrainDrive services are designed for personal knowledge management, AI-assisted thinking, and productivity. You are free to:

  • Store documents, notes, files, and other content in your Library
  • Use AI features to generate, organize, and explore your personal knowledge
  • Export your data at any time in full
  • Use approved tools and external connections on managed hosting
  • Purchase and use BrainDrive Models credits for AI model access
  • Participate in the BrainDrive Community forum
  • Use the service for personal or professional productivity

What You Cannot Do

You agree not to use any BrainDrive service to:

Illegal Activity

  • Store, distribute, or create content that violates any applicable federal or state law
  • Use the service in connection with any criminal activity

Intellectual Property Infringement

  • Store or distribute content that infringes the copyrights, trademarks, trade secrets, or other intellectual property rights of any third party
  • Accounts subject to repeated valid copyright takedown notices may be terminated under our DMCA Policy

Harmful Content & Code

  • Upload or store malware, viruses, trojans, ransomware, or other harmful code
  • Use the service to distribute spam, phishing messages, or fraudulent communications

Security Violations

  • Attempt to access another user’s account, data, or container
  • Probe, scan, or test the vulnerability of the service or any related system without authorization
  • Circumvent, disable, or interfere with security features, rate limits, or access controls
  • Interfere with or disrupt the service or the servers and networks that host it

Resource Abuse

  • Consume computing, storage, or network resources in a manner intended to degrade service for other users
  • Use automated systems (bots, scrapers, crawlers) against the service in a way that impairs performance

Resale & Unauthorized Use

  • Resell, sublicense, or provide access to the service to third parties without our written authorization
  • Share, resell, or redistribute BrainDrive Models API keys or credits
  • Use the service on behalf of a third party without disclosing this in your account

AI-Specific Restrictions

  • Use BrainDrive’s AI features to generate content that violates applicable law
  • Attempt to extract, reverse-engineer, or circumvent the safety measures of the AI models accessible through the service
  • Use BrainDrive Models API access in automated or programmatic ways that circumvent intended usage patterns
  • Route BrainDrive Models API access through third-party services or resell API access

Community Forum Restrictions

  • Post spam, promotional content, or unsolicited advertisements
  • Harass, bully, or intimidate other community members
  • Impersonate another person or misrepresent your affiliation
  • Post content that violates the intellectual property rights of others
  • Attempt to circumvent moderation actions or access restricted forum sections

How We Enforce This Policy

Our Monitoring Posture

We do not routinely or proactively monitor your private content (Library, chat history). Community forum posts are public and may be reviewed by moderators. We may access your account or content only when necessary for:

  • Legal compliance — responding to valid legal requests, including DMCA takedown notices, court orders, subpoenas, or law enforcement with proper legal process
  • Reported violations — investigating AUP violations reported to us by third parties or other users
  • Security incidents — addressing active security threats, unauthorized access attempts, or platform integrity issues
  • Preventing harm — responding to situations involving imminent risk of serious harm or fraud

What Happens If You Violate This Policy

We take a proportional approach to enforcement:

1. Notice and opportunity to cure. For most violations, we will notify you of the issue and give you a reasonable opportunity to address it. Many violations are unintentional, and we prefer resolution over punishment.

2. Content removal. We may remove or disable access to specific content that violates this policy, particularly in response to valid DMCA takedown notices or legal requests.

3. Account suspension. For serious or repeated violations, we may suspend your access to one or more BrainDrive services. For Concierge users, your data remains preserved and you can export it. For BrainDrive Models users, your API key may be temporarily disabled.

4. Account termination. For severe violations — including active security threats, illegal activity, fraud, or actions that endanger other users — we may terminate your access immediately. For Concierge users, your data is preserved for 30 days so you can export it (unless legally prohibited). For BrainDrive Models users, your API key will be revoked and remaining credits forfeited. For Community users, your forum access will be revoked.

What enforcement does NOT affect: Your self-hosted BrainDrive installation, your locally stored data, and your ability to run BrainDrive on your own hardware are never affected by enforcement actions on our hosted services.

We review all reports and respond as appropriate. We will not disclose your identity to the reported user unless required by law.

Changes to This Policy

We may update this Acceptable Use Policy from time to time. If we make material changes, we will notify you via email or through the service before the changes take effect. Your continued use of the service after changes take effect constitutes acceptance of the updated policy.
